Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard from working underneath a hydraulic lift not provided with a safety device. a) Front garage, bay 2 - Employees use a single-post, frame contact, hydraulic lift to elevate automobiles. An automatic mechanical device was not provided to hold the lift in the fully extended position at rated load capacity, thus exposing employees to injury from being struck by falling loads and/or lift parts on or about March 3, 2006. b) Front garage, bay 1 - Employees use a two-post, frame contact, hydraulic lift to elevate automobiles. An automatic mechanical device was not provided to hold the lift in the fully extended position at rated load capacity, thus exposing employees to injury from being struck by falling loads and/or lift parts on or about March 3, 2006. c) Back garage - Employees use a single-post, frame contact, hydraulic lift to elevate automobiles. An automatic mechanical device was not provided to hold the lift in the fully extended position at rated load capacity, thus exposing employees to injury from being struck by falling loads and/or lift parts on or about March 3, 2006. Feasible and acceptable abatement methods include, but are not limited to the following: 1) Install an auto-locking mechanism that sets as the lift is raised, such as the ones installed on the electric lifts. 2) Utilize the use of jack stands under the lift to protect employees. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
