North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)mezzanine -- a 2 ton JET overhead monorail crane was not provided with an initial load test prior to being placed into initial operation. Reference:ANSI B30.11- 1998; paragraph 11-2.2.2(a), Load Test Prior, New, altered, repaired, and modified equipment should be tested prior to initial use as determined by a qualified person. NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to have a load test conducted as per ANSI B30.11 - 1998.1

NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to conduct frequent inspections of the crane system as per ANSI B30.11 - 1998.

REFERENCE:ANSI B30.11 - 1998; paragraph 11-2.2.1, Operational Tests OR IN THE ALTERNATIVE: 29CFR 1910.179(n)(4)(i): At the beginning of each operator's shift, the upper limit switch of each hoist shall be tried out under no load. NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to have the upper limit switch tested prior to each days or operator's use/shift.
