Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that an employee was protected from falling as follows: a.Northwest side of the building, an employee was painting, on the building's wall, from a Genie Boom Lift, Z-45 Series, without being tied-off. The employee was exposed to a potential fall from a height of approximately 15 feet to the concrete pad below. Reference: ANSI/SIA A92.5-1992. Boom-Supported Elevating Work Platforms. Section 8.8: During operation. The aerial platform shall be used in accordance with this standard. Section 8.8(g): Ensure all personnel in the platform are wearing fall protection devices and other safety gear as required at all times. Reference: Genie Z-45/22 Series, Operator's Manual Safety Rules, Fall Hazards: Occupants must wear a safety belt or harness in accordance with government regulations. Attach lanyard to anchor provided in platform. One feasible means of abatement is to train the employee on the proper wear and anchorage of personal fall protection equipment in accordance with ANSI.92.5 and the operator's manual for the lift before operating the lift.
