Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to ensure a safe distance was kept as follows: (a)At the Wal Mart construction project, an employee was in the danger zone of a John Deere Back Hoe Bucket while the equipment was being used to excavate for a water stub, exposing the employee to serious injuries and/or death. Reference: Safety Manual For Operating and Maintenance Personnel: (a) A Word To The User/Operator - It is your responsibility to read and understand the safety manual and the manufacturer's manual(s) before operating this machine. (b) Follow A Safety Program - Keep others away from your operation. (c) Work Safely - Backhoe Safety Precautions - Make sure the area is clear of all persons before you start operating. WARNING: Never enter, or allow anyone else to enter, the backhoe swing pivot area. Death or serious injury can result. One feasible means of abatement is to ensure the safety procedures are read, understood and followed as required.
