Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The emp loyer failed to ensure fall protection was used as follows: (a)At the I-215 and Rainbow Overpass project, two employees, doing concrete patc h work in separate aerial lifts, a JLG 600S and a Genie S40, approximately 16 fe et high, were not wearing fall protection. Reference: ANSI A92.5 - 1992 Boom-Sup ported Elevating Work Platforms: Section 7.3.3 Pre-Start Inspection: Before use each day or at the beginning of each shift, the aerial platform shall be given a visual inspection and functional test including but not limited to the followin g: (c) Personal protective devices, including fall protection. Section 8.8 Durin g Operation: The aerial platform shall be used in accordance with this standard. The operator shall ensure the following before each elevation of the platform: (g) Ensure all personnel in the platform are wearing fall protection devices and other safety gear as required at all times. One feasible means of abatement is to make sure that the proper personal fall pr otection equipment required to do the job is provided and utilized.
