Nevada Revised Statute 618.375(1):  The employer failed to furnish
employment and a
place of employment which was free from recognized hazards that were
causing or were
likely to cause death or serious physical harm to his employees:
a.The employer failed to ensure that an employee was not transported
inside the
bucket of the Lieherr 964 Litronic Excavator; exposing the employee to a
fall
hazard of up to approximately 25 feet.
Reference: Operation and Maintenance Manual states: 1) Never allow other
personnel on the excavator.  2) Do not move the excavator until you are
certain
that no one is endangered by moving the excavator.
One feasible method of abatement, among others would be to follow the
Manaufacturers Operation and Maintenance Manual and not allow employees to
ride in the bucket.es
