North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to struck by hazards:
a)establishment, throughout - where underhung hoist such as, but not
limited to, a Yale 2 ton
hoist used on the catwalks with defects such as, but not limited to,
twisted
load chains, worn
and damaged bottom blocks had not been inspected in the past 12 months.
b)establishment, throughout - where underhung hoist(s) such as, but not
limited to, a Yale 2 ton
hoist on catwalks were not blocked where employee(s) were allowed to work
on and
underneath catwalks with the load on the hoist.
Abatement note:
One feasible and acceptable abatement method, among others, to correct
this hazard is provide conduct
annual inspections of the hoist and  provide blocks to release load on
hoist.

Complete inspections of the hoist shall
be performed at intervals as defined in 16-2.1.1(b)(2). ANSI B30.16-1981,
Section 16-3.1.3 (j): Personnel

that employees were exposed to fall hazards:
a)establishment, rough electrical area - where employee exposed to fall
hazard was standing on a
broken plastic top cap of  a Werner 8' fiberglass stepladder.
Abatement note:
One feasible and acceptable abatement method, among others, to correct
this hazard is provide conduct
inspections of the ladders and remove from service when defected.
[Reference ANSI A14.5-1992: Section 9.3.2 Climbing and Working Locations;
The user shall climb or work
with the body near the middle of the step or rung. The user shall not step
or stand higher than the step or rung
indicated on the label marking the highest standing level of a ladder. The
user shall not step or stand on a
ladder top cap and the top step of a step or trestle ladder, or the bucket
or pail shelf of a self-supporting
ladder. Section 9.4.1 Inspection; A through ladder inspection  shall be
made when the ladder is originally
purchased, received, and put to service. The ladder shall be inspected
periodically, preferably before each use.
Working parts and rung/step to side rail connections shall be checked.
Where structural damage or other
hazardous defect is found, the ladder shall be taken out of service and
either discarded or repaired by a
competent mechanic. Section 9.4.2 Damaged Ladders; Broken or bent ladders
shall be marked or taken out of
service until they are repaired by a competent mechanic or destroyed in
such a manner as to render them
