North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to the hazard of being struck by a falling
crane with attached load.
a)job site - FMC Linkbelt 108, 45 Ton capacity crane, that was used to
pick up a section of road
bed that weighed 16 tons. Crane was moving too fast during the lift and
turn, which caused the
momentum to topple the crane over - putting the load into the creek,
severing the power line,
and damaging the crane itself.
Reference: USAS B30.5 - 1968, Sect 5-2.2.3, paragraph c. 1: "During
hoisting care shall be
taken that:
1.  There is no sudden acceleration or deceleration of the moving load."
Among other methods, the operator should slow the movement of the crane to
diminish the
forces of momentum that build up during the lifting and moving of the load
