North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish to each of his employees  conditions of
employment and a place of
employment free from recognized hazards that were causing or likely to
cause death or serious physical
harm to employees, in that employees were exposed to fall from an
unapproved site-built personnel
platform:
a)main street - where the employer borrowed a wheeled, metal cargo dolly
from a local
business and installed a wooden pallet to its mid-rail to create a
platform 40 inches above
the deck of the dolly.  The platform had a metal top rail along two sides
without a mid-rail
with a platform of approximately 34 inches wide, 48 inches long and the
platform at
placed at 48 inches above the ground leaving an open front and back with
no toe board.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to use
appropriately designed personnel lifting equipment such as scissors-lift
type vehicles, bucket trucks or a
properly designed personnel platform.
