North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall from hazard by standing/working from the elevated forks of Swinger model 2000 loader while using a chainsaw to trim limbs from trees: a)Site - Employee was standing/working from the elevated forks of Swinger model 2000 loader while using a chainsaw to trim limbs from trees. Employee was approximately 10 feet above ground level making overhead cuts up to 16 feet on trees. Among other methods, one feasible method of abatement is to attach a personnel basket/work platform with safety rails to loader that allows employee to properly attach positioning belt while trimming trees. Reference: Owners operators manual, Swinger model 2000 Loader, page 1-6: Warning - Never use a bucket or blade as a work platform or personnel carrier.
