North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to a collapsing structure (re: para 102.5 Standard
Building Code and NC GS 160A-426):
a)311 South Elm St.- building damaged by a fork lift at the entrance,
which displaced part of the
foundation, had not been corrected.
One feasible means of abatement is to have the building repaired so as not
to present a hazard.
