North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)facility - where employees were allowed to use a Dayton 1 ton hoist to lift miscellaneous types of welding equipment weighing approximately 300 pounds and the hook on the hoist was missing a latch hook, the hoist had not been inspected in the past 12 months, the upper limit switch had not been tested. Ref: ASME B30.16-1981, Section 16-2.1(b)(2); Table 2 One feasible and acceptable means of abatement, among others, to correct this hazard would be to conduct inspections of the hoist, chain, hook, as specified in ASME B30.16-1981.
