Section 5(a)(1) of the Occupational Safety and Health act of 1970: The employer did not furnish employement and a place of employement which were free from recognized hazards that were likely to cause death or serious harm to employee in that employees were exposed to crushing hazards: Windsor Staging Area: An employee was observed operating a Mitsubishi forklift without wearing the seatbelt provided. Among others, one feasible and acceptable method to correct the hazard is to re-train employees regarding the importance of wearing seatbelts provided and by enforcing the policy that seatbelts must be used each and every the forklift is used.
