Section 5(a)(1) of the Occupational Safety and Health act of 1970: The employer did not furnish employement and a place of employement which were free from recognized hazards that were likely to cause death or serious harm to employee in that employees were exposed to crushing hazards: Yard: A.Employees operating the Clark forklift serial number 235-208-228 and Komatsu forklift serial number 5GX5-8 were not provided with seat belts. B.The use of the seat belts provided on the Yale forklift serail number N433848 was not enforced. Among other methods, one feasible and acceptable method to correct this hazard is to: Install a seat belt retro fit package and require that seat belts are worn while in operation.
