Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the Cedars at Wellington Lake construction site in Little Rock, AR, an employee was exposed to crushing injuries while the RSC Skytrac Model 8400 Rough Terrain Forklift, serial number P9989P5237 was operated without the use of a seat belt to move materials being supply to the site. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a policy that requires: the use of seat belts, communication of the policy to employees, and enforcement of the use of seat belts.
