Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard: Employees working as refuse collectors on the rear loading waste collection vehicles were exposed to the hazard of being struck by vehicular traffic and were not wearing reflective or high visibility vests or equivalent personal protective equipment. Violation observed on or about 1/25/05 ONE MEANS OF FEASIBLE ABATEMENT WOULD BE TO REQUIRE EMPLOYEES TO WEAR REFLECTIVE OR HIGH VISIBILITY VESTS.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard:The refuse truck being operated was known to have mechanical problems before being placed in service on January 19, 2005. Violation observed on or about 1/25/05. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS to repair and/or replace the solenoid speed up in accordance with ANSI Z245.1 6.1(d) which states repairing, prior to placing equipment into service, any mechanical malfunction or breakdown that affects the safe operation of the equipment.
