Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious injury while operating a motor vehicle without the use of a seat belt.Among other methods, one acceptable and feasible means of abatement would be to follow Adesa form 199-3-97 Motor vehicle Safety operation Requirements "Wear a seat belt at all times when operating a vehicle." (a) Location - Exit door of the "C" line: On or about 12/23/04, employees were exposed to serious injuries while operating a motor vehicle without the use of seat belts.
