Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that an employee
was seriously injured and later died of those injuries when fall
protection was not provided on
the platform of the Vertical Reciprocating Conveyor. Among other means,
three feasible and
acceptable means of abatement would be as follows; (a) Ensure the Vertical
Reciprocating
Conveyor is equipped with gates and enclosures as prescribed in ASME/ANSI
B20.1 and the
manufacturers owners manual as stated in section 1, page 6.(b) Ensure the
Vertical
Reciprocating Conveyor meets the applicable requirements for design,
inspection, testing,
maintenance, and operation as prescribed in ASME/ANSI B20.1 and the
manufacturers owners
manual as stated in section 1, page 17.(c) Train employees on the safe
operation and usage of
the conveyor as prescribed in ASME/ANSI B20.1 and the manufacturers owners
manual
in
section 1, page 6.
(a) Location - Grocery back-room, vertical reciprocating conveyor:
On or about 12/21/2004, an employee was seriously injured and later died
of those
injuries when fall protection was not provided on the platform of the
Vertical
Reciprocating Conveyor.
