Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about 04/04/05, and at times prior thereto, employees were exposed to the hazard of becoming caught between a rail car and a front-end loader being used to pull the rail car. One feasible and acceptable means of abatement is to use equipment designed to move rail cars and to follow company procedures stating, "The ground person must ride on the sill step of the end of the car or cars which is furthest from the direction of travel". "in a manner that maintains positive control of the car."
