Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a) On or about 8 June 2005, and at times prior thereto, employees were
riding in the bucket
of a "Caterpillar" Model IT38G front end loader where they were exposed to
the hazard of
being crushed by the bucket or run over by the machine.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to ensure appropriate transportation is use for personnel and enforce a
strict "No Rider"
policy on all equipment not designed for personnel transport.
