General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Construction Site; A fall hazard of approximately 45 feet to the ground below while being elevated on the forks of a Terex TH1056C Turbo rough terrain forklift without the use of a safety platform and without the operator being within 25 feet of the operators seat. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to provide equipment designed for personnel lifting, e.g. scissor lift or articulated boom lift or follow the requirements of ASME B56.6-1992 and ASME B56.6a-1994 Addenda when using the rough terrain forklift.
