Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Construction site; The hazard of being exposed to a fall of greater than 6 feet to grade while working from a pallet raised by the forklift. Among other methods, one feasible and acceptable means of abatement to correct this hazard while lifting personnel with a forklift is to follow the requirements set forth in ASME B56.60-1992 and ASME B56.6a-1994.
