Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Construction site: Employees exposed to a fall hazard while working from an elevated man basket which had no mid-rails in place. (b) Construction site: Employees exposed to a fall hazard while working in an elevated man basket which is not attached to the forks or mast. Among other methods, one feasible and acceptable abatement method to correct these hazards while using an all terrain forklift for lifting personnel is to follow the requirements set forth in the ASME B56.6-1992 and ASME B56.6a-1994.
