Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard from rollover of an All Terrain Vehicle: (a) Circus 3D field site near Wilsall, MT; On or about 31Aug06, an employee operating an Honda ATV with the front cargo rack loaded surpassing the manufacturer's maximum weight speficiations posted on the machine and listed in the owner's manual. Among other methods, one feasible and acceptable method to correct this hazard would be to reduce loads to those specified by the manufacturer.
