Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Construction site: Employees were exposed to a tip over hazard when a material basket is used in place of a man basket due to the excessive width of a material basket. Among other methods, one feasible and acceptable abatement method to correct this hazard while using an all terrain forklift for lifting personnel is to follow the requirements set forth in the ASME B56.6-1992 and ASME B56.6a-1994.
