Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Employee exposed to hazards such as but not limited to falling, crushing or a medical emergencies while the forklift is left unattended. One feasible and acceptable method to abate the hazards would be to have the operator at the controls or with in twenty five feet and in plain view as per the 2002 ASME B56.6.
