Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Construction site: Employees potentially exposed to a tip over hazard when a material basket that was excessively wide was used in place of a man basket. Among other methods, one feasible and acceptable method to correct this hazard while using an all terrain forklift for lifting personnel is to follow the requirements set forth in ASME B56.6- 1992 and ASME B56.6a-1994.
