Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical to employees in that employees were exposed to: (a) Employees exposed to hazards such as but not limited to struck by, and crushing due to unexpected start up or energy release. One feasible and acceptable abatement method to correct the hazard is to a) develop and implement a hazardous energy control program in accordance with ANZI Z.244.1 1982, b) 29 CFR 1910.147 and the API 54 August 1999, Recommended Practice for Occupational Safety for oil and gas well drilling and servicing operations.
