5(a)(1): Section 5 (a)(1) of the Occupational Safety and Health Act of
1970:  The employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to the anhydrous
ammonia hazards:
1.  A system component inventory list including specifications and details
of the system, system components,
pipe work and safety devices was not prepared and maintained.
(International Institute of  Ammonia
Refrigeration (IIAR) bulletin number 110, Guidelines for: Start-up,
Inspection and Maintenance of Ammonia
Mechanical  Refrigerating Systems, 1993, section 4.0).
2.  A full annual inspection was not performed (IIAR bulletin number
110,section 6.4.3).
3.  An independent full inspection by a competent person independent of
immediate commercial and
production pressures was not carried out at least every 5 years (IIAR
bulletin number 110, section 6.4.4.1)
4.  Pressure relief valves were not inspected  every 6 months and replaced
with new or overhauled and re-
calibrated valves every 5 years (IIAR bulletin number 110,section 6.6.3).
5.  Uninsulated piping was not inspected annually for any damage or
deterioration; areas affected by corrosion
were not cleaned off and the protective finish reinstated.  Deeper pitting
or loss of metal greater than 10if
original wall thickness should be checked by using ultrasonic or other
methods (IIAR bulletin number
110,section 6.7.1).
6.  The refrigerating machine room had wall openings to the stock pen and
no tight fitting door, opening
outward, was in place to separate the machine room from the rest of the
building (American Society of Heating
Refrigeration and Air-Conditioning Engineers (ASHRAE), Standard 15-2001,
2001, section 8.11.2)
7.  No detector was installed to actuate an alarm and activate mechanical
ventilation. Alarm must be set to the
corresponding TLV-TWA level (ASHRAE, Standard 15-2001,section 8.11.2.1).
8.  Mechanical ventilation system was not installed in the machine room;
unless electrical equipment designed
for hazardous atmospheres is installed in this room, the ventilation
should run continually. Refer to the section
8.11.4 !5 for the capacity of this ventilation system (ASHRAE, Standard
15-2001,section 8.11.3)
9.  A remote control located outside the machinery room door was not
provided for the purpose of shutting
down the equipment in an emergency (ASHRAE, Standard 15-2001, section
8,12i )
Among other methods,  feasible abatement methods are:
1.  Prepare a system component inventory list.
2.  Schedule and preform a full annual inspection.
3.  Schedule and preform an independent full inspection.
4.  Replace pressure relief valves which are older than 5 years.
5.  Inspect uninsulated piping  for any damage or deterioration, clean and
refinish  areas affected by
corrosion.
6.  Schedule and preform ultrasonic or other testing methods in all piping
areas
showing  pitting or loss of
metal greater than 10if original wall thickness.
7.  Install wall sections and self closing door to separate the machine
room from the rest of the building
8.  Install a detector to actuate an alarm and activate mechanical
ventilation. Alarm must be set to the
corresponding TLV-TWA level.
9.  Install a mechanical ventilation system in the machine room; unless
electrical equipment designed for
hazardous atmospheres is installed in this room, the ventilation should
run continually.
10. Provide a remote control outside the machinery room door for the
purpose of shutting down the equipment
in an emergency.
