Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about November 5, 2004, an employee performing masonry work, in particular scraping the block walls, was standing on a pallet that was on the forks of a Gradall rough terrain forklift truck. The worker was exposed to fall hazards in that their was no fall protection in place nor was the platform equipped with controls. Among other methods, one feasible and acceptable abatement method would be to comply with the ASME/ANSI B56.6-2002 for all rough terrain forklift trucks.t
