Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a Kawasaki Mule utility vehicle equipped with ROPs overturning or from the operator falling off the utility vehicle, due to the fact that the operator restraint systems (seat belts) provided on the vehicle were not complete and were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to properly install the seat belts and to require and to effectively enforce the use of the operator restraint systems provided by the manufacturer of the utility vehicle. a) Worksite: Two employees observed operating a Kawasaki Mule utility vehicle, Serial Number JK1AFBC18XB510771, were observed not wearing the seat belt provided, and sections of the seat belt were found to be missing.
