Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that an
employee was exposed to possible fall, and crushing hazards while working
from a
platform/cage on the elevated forks of a powered industrial truck, and the
platform's
guardrails were used as a lifting device.  Among other methods, one
feasible and acceptable
method to correct this hazard is for the employer to require and
effectively enforce the use of
proper lifting devices and gear when lifting light poles into position.
a) Northeast end of the jobsite: On or about March 9, 2012 The employer had
employees attach a 300 lb; 30-foot light pole to the top and/or mid rail
of a work
platform (which was elevated from a forklift) with a nylon choker. The
guardrail is
not rated, manufactured or intended as a lifting device.
