Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing
or likely to cause death or serious physical harm to employees in that
employees were exposed to the
hazard of being struck by approaching/passing vehicles:
a) Center line of Ustick Road, west of Meridian Road - Meridian, ID; On or
about 3/17/05, the
employer did not prevent an employee from standing in front of approaching
traffic, or in the middle
of the roadway and allowing traffic to pass on both sides while performing
flagging operations
exposing the employee to the hazard of being struck by passing vehicles.
Traffic speeds ranged up to
40 mph and were heavy with mixed vehicles ranging from passenger cars to
delivery trucks.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply with the
'Flagging Handbook' published by the Traffic Safety Service Association,
(14th Edition, 15 M, May
1994) or other association's/State's handbooks requiring flaggers to
always stand in a highly visible
location, and stand never directly in the path of an approaching vehicle.
