Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of a crushing injury from unstable natural stone slabs during slab transport operations: (A) Job site, on February 9, 2005 and at times prior employees were exposed to the hazard of being crushed by approximately 1200 pounds of natural stone slabs while setting them in a vertical position and attaching the lifter clamp. (B) Job Site, on March 18, 2005 and at times prior employees, while unloading slabs from flatbed trucks, were exposed to the hazard of being crushed when placing themselves in front of the slab being set in a vertical position. Among other methods, feasible and acceptable abatement methods to correct this hazard are to: (1)Move slabs by having two employees at the ends of the stone using a pinch bar and wedge, as recommended by the ABACO Lifter Operations Manual; this will assist in minimizing employees' exposure time to unstable stone slabs while attaching the ABACO Lifter Clamp. (2)Support the slabs with heavy nylon straps wrapped around the entire "A" frame rack until the slab is securely supported by the ABACO Lifter Clamp. (3)The slab should be mechanically stabilized or should be resting at a slight angle (not hand supported) against the A-frame rack while the lifting device is situated. A spacer may be inserted behind the slab to be lifted to provide an open space at the top to facilitate insertion of the mechanical lifting device. Note: Abatement certification and supporting documentation are required for this item.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating a powered industrial truck without wearing seatbelts: (A) Job site: on February 9, 2005 and at times prior the Clark forklift, ( S/N HY355-71-2544) was not equipped with a seat belt. ABATEMENT NOTE: One feasible and acceptable method of abatement, amongst others, would be to consult the forklift manufacturer to obtain a seatbelt kit. Note: Abatement certification required for this item.
