employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to hazards associated with not wearing seatbelts
when operating
powered industrial trucks:
(a)Job Site:  On May 5, 2005 and at times prior thereto, employees operated
powered industrial trucks without wearing seatbelts.
Note(1):  AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF
SEATBELTS WHEN OPERATING FORKLIFTS (POWERED INDUSTRIAL TRUCKS)
THROUGHOUT THE ESTABLISHMENT AS REQUIRED BY ANSI/AMSE B56.1,
PARAGRAPH 5.3.19.
