death or serious physical harm to employees in that employees were exposed
to the hazard of being struck by
approaching/passing vehicles:
a) Center of east bound lane - American Paving Project - Northview &
Esquire, Boise, ID; On or about
6/14/05, the employer did not prevent an employee from standing in front
of approaching traffic, or in
the middle of the roadway and allowing traffic to pass on both sides while
performing flagging
operations exposing the employee to the hazard of being struck by passing
vehicles. Traffic speeds
range from 0 to 35 mph and were heavy with mixed vehicles ranging from
passenger cars to
construction trucks.
b)Center of intersection - American Paving Project - Northview & Liberty,
Boise, ID; On or about
6/14/05, the employer did not prevent an employee from standing in front
of approaching traffic, or in

performing flagging
operations exposing the employee to the hazard of being struck by passing
vehicles. Traffic speeds
range from 0 to 35 mph and were heavy with mixed vehicles ranging from
passenger cars to

Among other methods, one feasible and acceptable method to correct this
hazard is to comply with the
'Flagging Handbook' published by the American Traffic Safety Service
Association, (14th Edition, 15
M, May 1994) or other association's/State's handbooks requiring flaggers
to always stand in a highly
visible location, and stand never directly in the path of an approaching
vehicle.
