Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard since seat belts were not available on a powered industrial truck. a)In the workplace, on or about and prior to 08/09/2005: Employees operating a Hyster Challenger 80 powered industrial truck (forklift) to stage materials did not wear seatbelts and were susceptible to being thrown from the controls in the event the equipment or material struck another object such as a structure or equipment. ABATEMENT NOTE: One feasible and acceptable means of abatement to correct this hazard is to install a seatbelt and require their use when operating powered industrial trucks (forklifts) throughout the establishment as required by ANSI/AMSE B56.1. NOTE: Abatement certification is required for this item.
