Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: (a)Pocatello Square job site: On Aug 5 2005,the controlling employer, Mickelson Construction, Inc., failed to ensure that its sub-contractor, Kase Concrete, protected its employee(s) from stepping into an uncovered sewer opening along the gutter. Note 1) One feasible and acceptable abatement method to correct this hazard is to install temporary coverings across all sewer openings until permanent standard grates can be installed. Note 2) Abatement certification is not required for this item.
