Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of being thrown off and
struck-by a forklift truck:
(a)On July 25, 2006, and at times prior thereto, an employee was exposed
to a hazard when operating the
GEHL rough terrain forklift without using the provided and functional
seatbelt.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to follow the
requirements of ANSI B56.6-2002 Standards for Rough Terrain Forklift
Trucks and the manufacturers
operating instructions which states that the operator shall fasten the
seat belt around them.
Note:  Abatement certification required for this item.
Evaluation of 5(a)(1)
(a)The employer failed to keep the workplace free of a hazard to which
employees of that
employer were exposed; employees were observed operating the GEHL rough
terrain forklift
truck with out the seatbelt being fastened.
(b)The hazard was recognized; There is an ANSI consensus standard
9B56.6-2002 and the
operator's manual which state to fasten the seat belts.
(c)The hazard was causing or was likely to cause death or serious physical
harm; Serious injury
or even death could result if the forklift turned over or the operator
fell out and was run over by
the forklift.
(d)There was a feasible and useful method to correct the hazard; develop a
work rule that requires
all operators to fasten the seat belt before moving the forklift truck.
