Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish a place of
employment which was free from recognized hazards that were likely to
cause death or serious physical harm
to employees in that an employee was exposed to a fall hazard by standing
on two midrails of an elevated
scissor lift platform;
(a)On July 25, 2006, and at times prior thereto, an employee  working in
the warehouse area of the
Cabela's store remodel was exposed to a fall of approximately 26 feet when
he stood on the midrails of
an elevated JLG scissor lift model 1930ES while reaching over his head to
straighten wires in a cable
tray.
One feasible means of abatement is to follow the requirements of ANSI
A92.3 -1999 Standards for Self-Propelled Elevating Work Platforms and to
follow the manufactures instructions to " Keep both feet firmly
positioned on the platform floor at all times.

Evaluation of 5(a)(1)
(a)The employer failed to keep the workplace free of a hazard to which
employees of that
employer were exposed; employee was observed performing an unsafe act.
(b)The hazard was recognized; the employee and employer both recognize the
hazard
(c)The hazard was causing or was likely to cause death or serious physical
harm; Serious injury
or even death could result of a fall from 26 feet onto concrete.
(d)There was a feasible and useful method to correct the hazard. See the
feasible means of
abatement above.
Or in the Alternative
29 CFR 926.451(g)(1)(vii): Each employee was not protected by the use of
personal fall arrest systems or
guardrail systems meeting the requirements of this standard.
(a)Job Site; on July 25, 2006, an employee was exposed to a fall hazard of
approximately 26 feet while
working from the mid rail of a JGL scissor lift, model 1930ES.
