Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an impalement hazard: (a) Waste water treatment plant jobsite: On February 27, 2006 and times prior thereto, employees were exposed to impalement hazards from unprotected rebar, including but not limited to, bracing stakes for form work. Note 1) One feasible and acceptable abatement method to correct this hazard is to install protective shields on protruding rebar bracing stakes. Note 2) Abatement certification is required for this item.
