Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to hazards resulting from being backed over by vehicles with obstructed views to the rear which do not have operable stop & reverse lamps and audible reverse signal alarms above the surrounding noise levels. a)FITCHBURG PLANT; THE TWO 1987 OSHKOSH CEMENT MIXERS WHICH WERE IN SERVICE AT THE PLANT FOR LOLLY COLUMN FILLING OPERATIONS HAD OBSTRUCTED VIEWS TO THE REAR OF THE VEHICLE FROM THE OPERATORS CAB AND NEITHER VEHICLE HAD OPERABLE TAIL, STOP OR REVERSE LAMPS AND NEITHER VEHICLE HAD OPERABLE AUDIBLE REVERSE SIGNAL ALARMS TO WARN EMPLOYEES WHEN THE VEHICLE WAS BACKING UP.
