Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being struck or crushed by automobiles being lifted on an automotive lift that had a defective safety device. One feasible and acceptable method to correct this hazard is to ensure that there are functional positive stops on the lift to enure that a raised automobile can not be inadvertently lowered by employee error or by mechanical failure. A) LOCATION: LAST BAY ON NORTH SIDE OF BUILDING THE PEARSON 12000 POUND LIFT WAS NOT SUPPLIED WITH A FUNCTIONAL SAFETY LATCH TO ENSURE THAT THERE WAS A POSITIVE MEANS IN PLACE TO PREVENT A RAISED AUTOMOBILE FROM COMING DOWN FROM ITS RAISED POSITION INADVERTENTLY, STRIKING WORKERS WORKING AROUND AND UNDER THE VEHICLE. THE LIFT WAS DESIGNED WITH SAFETY LATCHES THAT CLICK INTO PLACE SECURING THE VEHICLE, BUT THE FRONT SAFETY LATCH MECHANISMS WERE BROKEN.SMS
