Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to burns and respiratory damage from an uncontrolled release of acidic gases resulting from the addition of excessive amounts of sulfuric acid to the "anode day tank". Among other methods, feasible and acceptable means to correct the hazard would be to use flow control metering devices to precisely control the volume of acid being added, installation of temperature sensors or the use of load cells to accurately determine the weight of acid additions.
