North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being thrown from fork lift truck: a)production and warehouse areas, employees operating fork lifts were at risk of being thrown from fork lifts because they did not wear the seat belts provided on the units (Reference ASME B56.1-2000, 5.3.19) ABATEMENT NOTE:Among other methods, one feasible and acceptable abatement method to correct this hazard is for the fork lift operator wear the seat belt provided on the fork lift.
