Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Hazards created by the use of elevated work platforms which were not
designed, constructed
and/or used in accordance with the acceptable requirements of the American
National Safety
Standard for Rough Terrain Forklift Trucks, ASME B56.6-2005.  The
personnel platform and
its use did not meet the design requirements of that standard in the
following areas:  A trained
operator was not in position to control the rough terrain forklift or
available to operate the
controls.  When the operator was not in the operating position, the truck
wheels were not
blocked and the parking brake was not applied with travel controls in
neutral.  These conditions
existed when an employee was working on a residential building from a
platform
attached to the
forks of a rough terrain forklift.
Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to assure that the design, manufacture and use of all attachments for
Rough Terrain Forklift
Trucks are in accordance with the most current American National Standard,
B56.6 (presently
B56.6-2005), and/or has the prior approval of the lift truck manufacturer.
