Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to: Hazards associated with falls while climbing into and out of the Skyjack scissor lift that was in an elevated position. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with the manufacturer's requirements and ANSI/SIA A92.6-1999 for Self-Propelled Elevating Work Platforms. Section 8.10(28) requires: "Vacating (or entering) an elevated aerial platform. If permitted by the manufacturer, personnel shall only vacate or enter a raised aerial platform by following the guidelines and instructions provided by the manufacturer." Additionally, the manufacturer's manual for the scissor lift requires: "Entering and exiting the aerial platform should only be done using the three points of contact system. Use only equipped access openings and ladders. Enter and exit only when the aerial platform is in the fully retracted position."

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to: Hazards created by the use of personnel platforms in conjunction with rough terrain forklifts. An operator was not at the controls, and the wheels were not blocked/chocked. Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with the manufacturer's requirements and ASME B56.6-1994 for Rough Terrain Forklift Trucks. Section 5.15(s) requires: "When the operator is not in the operating position, block the wheels and apply the parking brake with all travel controls in neutral."
