Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 4/13/05, employees were exposed to crushing hazards in that employees were not prohibited from being in the crane's danger zone areas such as near the crane's wheels and in the vicinity of the crane's path of travel. Among methods, one feasible and acceptable method to abate this hazard is to comply with the Liebherr Volume 1 Operating Manual for Type LHM 400 Leibherr Harbor Mobile Crane section 3.9.1: No one may stand in the danger zones of the machine; section 3.12.1 The assistant may not stand in the danger area or in the immediate vicinity of the machine's path of travel; and section 5.1.2 Dangerous Area and Special Safety Regulations: Unauthorized persons being within the maximum extended safety radius or under a suspended load is strictly forbidden.

Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 4/13/05, employees were exposed to crushing hazards in that the crane wheels were not guarded in a manner that would push a person away from the wheel. Among methods, one feasible and acceptable method to abate this hazard is to install personnel deflecting device guards on the wheels of the LHM 400 Leibherr Harbor Mobile Crane. CERTIFICATION OF ABATEMENT IS REQUIREDT
