Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees, in that employees were exposed to a struck by hazard: On or about 05/26/05, employees who were operating forklifts in the recieving area, were not wearing seat belts, and were exposed to the hazard of falling out of and being struck by the equipment. Among other methods of abatement, a feasible and acceptable method to correct this hazard is to ensure employees are wearing the seat belt when operating the equipment. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
