Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or were likely
to cause death or
serious physical harm to employees, in that employees were exposed to a
struck by hazard:
On or about 06/18/05, an employee who was operating a New Holland Skid
Steer loader was
not wearing a seat belt, and was exposed to the hazard of falling out of
and being struck by the
equipment.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is
to ensure employees are wearing the seat belt when operating the equipment.
PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS NOT
REQUIRED FOR THIS VIOLATION.

On or about 06/18/05, and on previous occasions, an employee was operating
a New Holland
Skid Steer Loader that had the side screens removed, exposing the employee
to the pinch point
created by the bucket arms and the loader frame.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is
for the employer to ensure all side screen guards are in place prior to
use.
PLEASE NOTE:  CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.

Skid Steer Loader that had a damaged hydraulic hose, defective springs
that held the front end
loader bucket, and other machinery defects such as loose or damaged
controls.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is
for the employer to ensure the equipment is repaired according to the
manufacturer's
specification and ensure it is in safe operable condition.
PLEASE NOTE:  CERTIFICATION AND DOCUMENTATION OF ABATEMENT IS
REQUIRED FOR THIS VIOLATION.
